كسب فريق شركة #لافين حكمًا قضائيًا بإلغاء قرار هيئة الزكاة والضريبة والجمارك برفض استرداد ضريبة. سبب النزاع يستحق التوقف: الهيئة اشترطت وسائل إثبات محددة لإثبات حصرية استخدام المركبات، رغم عدم وجود نص نظامي يُلزم بذلك. وكان دفعنا أمام الدائرة أن وسائل الإثبات حرة، ولا يجوز تقييدها إلا بنص نظامي. وجاء الحكم متوافقًا مع هذا الدفع، مؤكدًا أن اشتراط وسائل إثبات غير منصوص عليها نظامًا لا يصلح أساسًا لرفض طلب الاسترداد، ومن ثم قضى بإلغاء قرار الهيئة. ويبقى السؤال: كم قرارًا إداريًا يُبنى على اشتراطات لا سند لها من النظام، ويُسلَّم بها دون أن تُختبر أمام القضاء؟ #القضاء_الضريبي #ضريبة_القيمة_المضافة #محاماة #هيئة_الزكاة_والضريبة_والجمارك
