Y entonces nos enteramos de que la propia cuñada del corrupto fiscal Karim Khan era pagada por el régimen chavista para defender a Maduro. El fiscal, por supuesto, no objetó que su cuñada defendiera al tirano. También supimos que, ante tanta obscenidad, el más prestigioso asesor de Khan, el abogado de derechos humanos Claudio Grossman, renunció. Grossman argumentó que sus “estándares éticos” le prohibían seguir en la Corte tras la reticencia del fiscal de perseguir a Maduro. Con Maduro, el peor violador de derechos humanos del hemisferio, la Corte se demoró años investigando para nunca hacer nada. Como venezolano, contrarío este planteamiento y hago votos, no solo para que no sea oído sino ademas, para que quienes lo emiten, lo revisen y corrijan: El Estatuto de Roma y la Corte Penal Internacional (CPI) no son caprichos burocráticos; son la evolución jurídica de la conciencia humana. Existen crímenes que, por su atrocidad y carácter sistemático, no solo dañan a la víctima directa, sino que agreden la condición humana en su totalidad. Las fallas operativas y omisiones coyunturales de sus funcionarios —como los cuestionamientos a las gestiones de su fiscalía— jamás justificarán desmantelar el andamiaje institucional que protege a las víctimas frente a los abusos del poder. El concepto clásico de soberanía absoluta ha mutado internacionalmente. Hoy, la soberanía estatal no es una patente de corso para la opresión ni un escudo para garantizar la impunidad de las élites gobernantes. La soberanía se legitima únicamente a través del cumplimiento de un deber primario: la protección y garantía de los derechos fundamentales de sus ciudadanos. Cuando el Estado abdica de este deber, pierde el monopolio ético de su autonomía territorial. La justicia internacional interviene legítimamente bajo el principio de complementariedad cuando los tribunales nacionales no pueden o no quieren actuar frente a los crimenes que cometen sus gobernantes. Esta inacción se vuelve crítica cuando las estructuras estatales son capturadas por organizaciones criminales transnacionales que operan bajo fachadas institucionales. Ante la delincuencia institucionalizada que desborda fronteras, la respuesta jurídica y de fuerza internacional debe ser igualmente coordinada, cooperativa y libre de ataduras geográficas. Frente a los regímenes autocráticos, la comunidad internacional democrática no puede asumir un rol de espectador pasivo. La persecución universal que a traves de la CPI se hace de los crímenes de lesa humanidad constituye un imperativo ético de corresponsabilidad global.
