Não se questiona a necessidade de investigar os graves fatos noticiados e punir eventuais culpados. Questiona-se a imparcialidade de um ministro que governou o Maranhão por dois mandatos para atuar em casos que envolvem o Estado e o grupo político com o qual rompeu politicamente. Além da ausência de competência do STF, Dino deveria se declarar impedido, assim como deveria ter feito ao julgar Bolsonaro. Isso também vale para Alexandre de Moraes, que se declarou vítima dos atos que ele próprio analisou. Além disso, conduz um inquérito interminável iniciado em 2019 e que coloca uma espada na cabeça de qualquer pessoa que ouse criticar sua atuação. A relativização do foro e o cerceamento de garantias individuais no processo contra Bolsonaro foram inúmeras. Para citar um único exemplo, mais de 200 milhões de mensagens e áudios foram entregues à defesa às vésperas do julgamento, tornando humanamente impossível sua análise.
